What is a Planning Permit

A planning permit is a legal document that gives permission for a land use and/or development on a parcel of land.

You may need a development planning permit to demolish, extend or construct a single dwelling; build a multi-dwelling development, remove a tree or build an industrial building.

Recently, DLM Town Planning has received a number of enquiries regarding ‘uses’ within industrial areas. Small business owners have been operating in an industrial area without knowing a planning permit was required for their business. Small business owners become aware of a ‘use’ planning permit is needed when the local Council notifies them that they are operating in contravention of the municipality planning scheme.

Under Industrial zoning, leisure and recreation activities such as a dance studio, personal training or retail premises such as a café require a ‘use’ planning permit. A ‘use’ planning permit will contain conditions generally relating to hours of operation, number of clients/patrons and staff that can be present on the land/premises at any one time or the number of car parking spaces that should be provided for clients/patrons and staff.

DLM Town Planning recommend before signing a lease for a premise, discuss how you propose to use your site with your local Council’s Planning Department. They can advise whether your proposal requires a planning permit, if the proposal is prohibited and what information will be required to support your application and outline the planning process.
